Recently, an accident victim who had been injured in an Uber accident accepted the first settlement offer from the insurance company: $2,000. He signed a release believing the offer was fair and that the matter was resolved.
What he didn't know was that signing the release could permanently end his claim.
After a release is signed, an injured person may no longer be able to seek additional compensation, even if medical treatment continues, additional injuries become apparent, or the settlement does not fully cover the losses resulting from the accident.
The problem wasn't that he didn't care about his claim. He simply didn't have the information he needed to make an informed decision.
And that's common.
After an accident, most people aren't thinking about insurance policies, settlement negotiations, releases, or the potential value of their claim. They're focused on getting medical care, repairing their vehicle, getting back to work, and taking care of their families.
That's why it's important to understand your rights before accepting an insurance settlement.
An insurance offer may not account for everything an injured person could be entitled to recover. Factors such as the severity of the injuries, medical treatment, lost wages, pain and suffering, and the impact the accident has on someone's daily life can all play a role in determining the value of a claim.
Most importantly, once a release is signed, there may be no opportunity to go back and ask for more.
Before You Sign, Understand Your Rights
